Robert Fillingim's Will dated October 8, 1798, Craven Co., N.C.

• This Will was probated March Term 1799, Craven County.

"In the name of God, Amen, I, Robert Fillingim of Craven County in the Provence of North Carolina being at this time by the blessing of God in health of body and of sound mind and memory, but knowing that it is appointed for all men to die and that the time and manner there of, is uncertain, do make and ordain this my last Will and Testament..."

"Item: I give to my beloved sons, Enoch and John Fillingim the land and plantation where I now live, to be divided between them equally beginning at the river... I give to my son Enoch, my horse named Jack..."

"I give unto my Daughter Polly, one Bed and furniture and one Desk and one cow and calf, and one small pot, half a Dozen Fowls, and one bee hive..."

"I give unto my sons, John and Benjamin the furring (?) hogs likewise the whole crop equally to be divided between the two. And now, I give to my son, John, my flax and cotton. I give to my son, Benjamin, one hundred acres of back land beginning at a frofilor (unable to read this word). I give to son Benjamin, one Bed and furniture, one heifer, one bee hive, one small sow and her increase and one skillet."

"And all my other house hold goods laid into these lotts equally and Polly, John, Benjamin to draw for them, and I hereby nominate and appoint my son, Enoch, and my brother, Jarvis Fillingim, Executors of this my last Will..."

The Will is hand written. It is fairly easy to read.

Robert Fillingim does not mention his wife. Did she die before him?

Where Robert mentions his brother as executor- it looks like James Fillingim. But as Robert does not have a brother James- it must be Jarvis. The handwriting of "James" and "Jarvis" is almost identical.

Robert's brother, Jarvis Fillingim (born Sept. 1754) married Elizabeth Ince in 1782 in Craven Co.

Another brother, Benjamin Fillingim (born Aug. 1, 1756), married a "Elizabeth" also. This Benjamin is in the 1790 Craven Co., census.
